Terms of Service

These Terms of Service ("Terms," or the "Agreement") constitute a legal agreement; please read them carefully. By using our Service, utilising Content produced by our Service, or delivering Merchandise to us, you agree to these Terms. Your continued use of our services constitutes your acceptance of these Terms and Conditions.

Photograph My Product (the "Service") primarily produces product photography and related Content, which may include photographs, graphics, video, audio recordings, and artwork (collectively referred to as "Content"). Any products or other items that you send to us, whether as the primary subject, supporting prop, or anything else, we refer to as "Merchandise" in these Terms. Our Website, accessible at www.photographmyproduct.co.uk, is referred to as the "Website."

Photograph My Product Ltd., Company number 11588835 ("photographmyproduct.co.uk," "we," or "us"), owns and operates the Website. By using our Service, whether as an individual or as a representative of an entity, you are a "Client" (or "you") according to these Terms. Acceptance of any estimate or invoice from us constitutes your agreement to these Terms and Conditions.

Agreement to Terms and Conditions

New Clients: All new clients must review and agree to our Terms and Conditions before any work commences. A link to our Terms and Conditions will be included in the initial estimate and must be agreed to before work begins.

Repeat Clients: For repeat clients, we assume your continued use of our services indicates your ongoing agreement to our Terms and Conditions. Any significant changes to our Terms and Conditions will be communicated to you, and your continued use of our services after such notification will constitute your acceptance of the updated Terms and Conditions.

Invoicing and Documentation: Acceptance of any estimate, invoice, or project-related communication from us constitutes your agreement to our Terms and Conditions. This applies to both new and repeat clients.

Updates to Terms and Conditions

We may update or make changes to these Terms by posting the revised Terms of Service on our Website. The revised Terms shall take effect and remain in full force immediately upon publication. It is your responsibility to review these Terms periodically. Continued use of our services after any such changes constitutes your acceptance of the new Terms.

Summary of Client Responsibilities

Providing Specific Briefs: Clients must provide clear, specific briefs for their projects. Generalised briefs may lead to creative decisions being made by our team, for which you will be financially responsible regardless of your satisfaction with the outcome.

Advance Booking and Scheduling: Clients are encouraged to book projects well in advance to ensure timely service. Turnaround times depend on the complexity of the work and our current schedule.

Agreement to Terms: By accepting any estimate or invoice from us, you agree to these Terms and Conditions. This applies to both new and repeat clients.

1. Eligibility

To use our Service, you must: be at least 18 years of age and able to enter into legal contracts; submit a completed "Start your order" form; agree to these Terms of Service; and provide complete, true, and current contact information.

2. Communication

We will send information about your account, your order, billing, your Merchandise, legal notices, or anything else related to the Service to the email address you provided when starting your order. We may also contact you via telephone and postal mail but are not required to do so. Ensure any email from the domain "photographmyproduct.co.uk" is added to your "whitelist" to help ensure delivery and prevent it from being rejected or deleted as junk or spam.

3. Merchandise

You are responsible for the costs of sending your products to and from our studio, including any necessary insurance. Choose a shipping provider with reliable tracking information and signature confirmation. We are not responsible for loss, damage, or delay if a shipment is lost, delayed, or damaged while in transit to our studio.

Prohibited Items: Do not deliver any Merchandise containing narcotics, illegal drugs, controlled substances, dangerous weapons, firearms, explosives, dangerous chemicals, obscene or pornographic materials, or any merchandise unlawful to possess in the UK.

Sending Products to Us: When shipping Merchandise to our studio, carefully pack packages to ensure the protection of the Merchandise during transit. Include your name, company name, address, email address, and phone number in all packages. Address shipments to Photograph My Product Ltd., Commercial Unit E1, Northminster Business Park, York, YO26 6QU.

Condition of Returned Merchandise: While we make every effort to keep Merchandise as clean and scratch-free as possible, we cannot guarantee that items will be returned in a sellable condition. During the photography process, it may be necessary to use sticky tape, remove labels, or adjust the products to achieve the desired look. As such, you accept that there may be minor alterations or marks on the Merchandise when it is returned.

Return Shipping: We offer a shipment service through DPD. Prices depend on the size, weight, and location of the items. The cost of return shipping and handling will be quoted prior to shipment. Clients must be upfront about the specifics of their shipping requirements. Additional costs incurred due to inaccuracies or omissions must be paid before the items are dispatched back to the client. Provide a physical address (no PO boxes) for return. You may also pick up your products at our studio during business hours. Once the shipping company collects the merchandise from our studio, we are no longer responsible for it. If you want to guarantee delivery, you can either collect the products in person or arrange collection yourself. All return shipments are subject to our Limitation of Liability in section 3(e) below.

Limitation of Liability for Damage or Loss of Merchandise: If your Merchandise is damaged or lost while in our possession or during return shipment, we will, at our option, replace, repair, or reimburse you for the value of the Merchandise up to a maximum of £500 total lifetime aggregate. For Merchandise valued greater than £500, you should purchase your own insurance covering loss or damage to the Merchandise while in our possession and during transit to and from our studio. We are not liable for loss or damage to Merchandise exceeding a total value of £500, regardless of quantity.

Storage: Upon request, we will store your Merchandise in our facility free of charge for up to 30 days after project completion (completion means after the final images are sent to the customer). After 30 days, a storage fee of £5 per day will be incurred. You must arrange for the Merchandise to be returned, picked up, donated, or discarded before this period ends. If no arrangements are made within 30 days, the Merchandise will be subject to our Abandonment policy in section 3(g) below.

Donating or Discarding: If the value of some Merchandise is less than the cost of return shipping, please inform us if you do not want the Merchandise returned. We will donate or discard the Merchandise. We do not offer compensation or credit for donated or discarded Merchandise. If you choose to have your Merchandise donated or discarded, we will decide which persons or organisations receive the Merchandise or whether it is discarded.

Abandonment: If we do not receive your return shipping information or payment for return shipping within 60 days after project completion, all title, interest, and ownership of the Merchandise shall be transferred to us, and the Merchandise will be donated, discarded, or sold, at our option, with no compensation to you.

Loss of Items: In our busy studio environment, there is a small risk that items may be misplaced or lost. While we make every effort to handle and track all Merchandise carefully, we recommend you do not send irreplaceable or high-value items without appropriate insurance. Our liability for any lost items is limited as described in section 3(e).

4. Invoicing and Payment

Payment Terms and Deposit Requirement: A 50% proforma invoice (deposit) is required before we commission any work on your project. We reserve the right to request full payment upfront for overseas customers or at our discretion. The remaining balance is due in accordance with your project's invoice terms once the work is completed according to the agreed brief.

Non-payment: If payment for our services is not rendered, we may take legal action to collect payments due and withhold goods. We may also exercise our rights under the Digital Millennium Copyright Act to issue takedown notices requesting the removal from website(s) of any Content we've delivered to you that has gone unpaid. We may also seek injunctive relief to prevent unpaid Content from being published, reproduced, or displayed. Additionally, we may pursue legal action for actual, statutory, and punitive damages for copyright infringement if you publish or use our Content without remitting payment.

Payment Schedule: Payment in full is due no later than 14 days after the content is delivered. Failure to make the payment within this period will result in a late payment fee plus statutory interest (8% plus the current Bank of England base rate): An additional £40 fee will be applied for debts less than £1,000 (plus statutory interest). An additional £70 fee will be applied for debts between £1,000 and £10,000 (plus statutory interest). An additional £100 fee will be applied for debts greater than £10,000 (plus statutory interest). If the full payment, including any late fees, has not been made within 7 days of the notice, further action will be taken. This may begin with mediation, followed by court action if mediation is unsuccessful.

5. Refund Policy

Payments made to us are refundable under limited circumstances as outlined below. No other refunds, returns, exchanges, or changes may be made except for the following:

Rush Projects Not Completed by the Deadline: If a rush order is not completed on time, we will refund the rush fee portion of the project. No other refunds will be made for rush orders delivered after the deadline indicated on the invoice.

Project Abandonment with Full Payment: If you have fully paid for a project (i.e., paid the total invoice amount) but do not respond to our communications or fail to provide necessary approvals, feedback, or instructions for more than 90 days, the project will be deemed abandoned. Under these circumstances, you will not be entitled to a refund. However, you may request a credit on your account for future projects. This credit will be offered at our discretion and must be used within 12 months of the date we confirm the credit.

6. Pricing

Our current pricing is published on the pricing page of our Website. We may change the prices we charge for our services at any time by publishing the new rates on our Website. We may offer other services not listed on our pricing page and, if applicable, those rates will be disclosed prior to work being performed.

7. Taxes

You agree to be responsible for and pay any and all applicable sales, use, or value-added taxes, or duties imposed by any jurisdiction as a result of the work performed for you by us or in connection with any licence we grant to you. A 20% VAT will be added to your invoice. Our VAT number is 307142144.

8. Production, Briefing, and the Creative Process

We expect every client to provide an accurate and specific brief, covering aspects of the Content including but not limited to: the merchandise required in each image; the arrangement or styling of each image; specific props to be used in each image (you must provide the props or accept the props we provide on your behalf); and the specific colours or backgrounds to be used for each image.

If the content is not specified exactly in the brief, we will exercise our creative direction on your behalf. You waive the right to request changes to the Content once it is complete and must accept and pay for the work delivered. Any aspects of the brief not specifically directed or open to interpretation will be left to the judgment of our production team.

Generalised Briefs: If you provide a generalised brief (e.g., "shoot the product in a kitchen") without specific details, you accept that the artistic and creative decisions will be made by our production team. We will not be responsible for any dissatisfaction if the resulting Content does not match an unspecified vision. Requests for changes, re-edits, or reshoots beyond a single complimentary round of edits (or outside the scope of the agreed invoice) will incur additional charges. Endless or indefinite reshoot requests will not be accommodated without further costs being quoted and agreed in writing.

Changes to Brief: Any changes to the original brief that match the estimate must be communicated prior to the commencement of the product shoot, which may begin as soon as the product arrives at our studio. Such changes must be communicated in list form by email and acknowledged by a member of our team. Alterations are not allowed once the imagery has been created.

Estimates, Invoices, and Attachments: We will complete your order as described on the estimate/invoice and any attached documents. It is very important that you carefully read the estimate/invoice and any attachments to ensure they accurately describe the work you would like us to perform. If the estimate/invoice is not accurate, do not accept it or submit payment. Instead, contact your project manager for the necessary changes. By submitting payment for an invoice, you agree that the invoice correctly describes the work you would like us to perform.

Review Period: Immediately after the project is complete, you will receive an email containing a link to view the Watermarked Content. We allow up to 7 days for you to provide us with feedback regarding the delivered Content. After 7 days, if we have not heard from you, we will invoice you for the work completed, and your order will be closed. Your Merchandise will not be returned until the invoice is paid in full.

Reshoots and Edits: During the review period, you may contact us to request changes to the Content, such as reshoots, edits, or additional photos. We will reshoot or edit photos free of charge only if: we have made an error and delivered work that does not match the invoice and accompanying shot list; or there is a minor edit needed that can be resolved without reshooting (e.g., small colour or tone adjustments). We offer one (1) complimentary round of editing at your request for such minor tweaks.

Additional Charges: Some change requests made during the review period may require an additional charge, including but not limited to: Additional Photos — if you request extra images not included on the invoice; and Reshoots — if the original brief was followed but you want to alter the lighting, arrangement, camera angle, or other significant factors, these requests will be quoted separately.

9. Delivery

After production is complete, the Content will be delivered through our Image Hosting Service. We will email you a link to view and download all work completed for you. We contract with a third-party vendor to manage the website and software for our Image Hosting Service. While we make every effort to ensure availability, stability, and security, we cannot guarantee 100% uptime or protection against all attacks. We are not responsible for loss associated with the availability, security, or confidentiality of the Content delivered through our Image Hosting Service. We recommend making backup copies of all Content for your records. We are not obligated to store or archive the Content, and any storage provided should be considered a convenience only.

10. Licence and Permitted Use of Content

You may use Content we deliver to you in connection with your order, only after full payment, for any permitted use that does not violate this Agreement. The rights granted herein are subject to the prohibited uses in Section 11. We hereby grant you the following rights:

Perpetual Use: You can use the Content forever, with no end date.

Exclusive Use: You have the exclusive right to use the Content, meaning we will not license the Content to other parties. However, we retain the right to use the Content for our promotional publication and internal use.

Worldwide Use: You may use the Content worldwide.

Unlimited Use: You may use and display the Content an unlimited number of times, except as provided in section 11(b) below.

Derivative Works: You may modify, retouch, combine, crop, annotate, or otherwise edit and create derivative works from the Content. Our Content within derivative works remains our copyrighted material, and the terms and restrictions within this licence also apply to those derivative works.

Permitted Uses: Permitted uses include but are not limited to websites, online stores, online advertisements, email newsletters, video, film, television, printed advertisements, printed catalogues, product packaging, billboards, computer software, and mobile applications.

By commissioning our services, you acknowledge that Photograph My Product Ltd. retains all copyright and intellectual property rights to the Content. The licence granted to you is solely for the permitted uses outlined above and does not constitute a transfer of ownership.

11. Prohibited Uses

Unlawful Use: You may not use the Content in any illegal manner, defamatory manner, or to harass any person. Content may not be used for pornographic purposes or in any way that violates the trademark, copyright, or other intellectual property of any other party.

Logos and Trademarks: Content may not be used as part of or incorporated into any logo or trademark.

13. Intellectual Property of Third Parties

Intellectual Property Visible on Merchandise: Merchandise you direct us to photograph, or props used in conjunction with that Merchandise, may contain trademarks, logos, artwork, or copyrighted designs visible in the finished Content. By directing us to photograph such Merchandise, you certify that you own or have received explicit permission to use any and all intellectual property visible on the Merchandise. You are responsible for obtaining the necessary permission to use all intellectual property visible within the Content.

Stock Photography and Artwork: If stock photography or other artworks owned by third parties are incorporated into the Content, we certify that this content has been paid for and/or licensed by us for use in accordance with the respective supplier's terms. When printing Content containing stock photography and artwork, the maximum number of printed copies shall not exceed 500,000. This restriction does not apply to electronic displays, such as on a website.

14. AI Imagery and Generative Tools

We may use AI-assisted and generative workflows as part of production, including retouching, compositing, and synthetic scene creation.

AI output is probabilistic and may not be unique. We provide licence rights for delivered assets subject to payment.

You are responsible for compliant and non-misleading use of AI-assisted or AI-generated outputs, including disclosures where required by applicable law, regulation, or platform policy.

You must not use delivered content to train or fine-tune AI models unless agreed in writing.

15. Data Protection and Confidentiality

Each party acts as an independent controller of personal data processed under this Agreement.

Both parties must comply with applicable UK data protection law (including the UK GDPR and Data Protection Act 2018) and keep confidential information secure.

We may use reputable third-party providers (for example, hosting and storage) under appropriate contractual controls.

16. Models

Model Sourcing: We do not have on-site models. Models must be sourced through modelling agencies, which may incur additional costs and usage fees outside of our business organisation.

Client-specified Models: If you require specific models for your project, you must select and arrange for these models before the shoot begins. All costs associated with client-specified models, including fees and any additional expenses, are your responsibility.

Models Chosen by Us: If you prefer us to choose the models, we will select appropriate models from our network of agencies. The costs for these models, including any agency fees and usage rights, will be detailed on your invoice and must be paid upfront before the shoot begins. By allowing us to choose the models, you accept responsibility for the images produced with these models.

Model Releases: We certify that we have obtained appropriate releases from any models depicted in the Content. The Content will not infringe on any moral right, privacy right, or right of publicity of any model depicted within the Content, provided the Content is used in accordance with Sections 10 and 11 of this Agreement.

Usage and Additional Costs: Any additional costs for model usage, including but not limited to usage fees for different media or extended usage periods, are the client's responsibility and will be clearly outlined in the invoice.

17. No Warranties

The Content is provided, to the maximum extent permissible by law, "as-is" with no warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. We do not warrant or represent that the Content will meet your requirements or that it will be free of errors.

18. Website

Access and Use of Content: Unless noted otherwise, all materials on the Website, including text, images, logos, icons, photographs, and any other materials, are copyrighted property owned by Photograph My Product Ltd., one of its affiliates, or by third parties who have authorised their materials for use on our Website. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell, or exploit in any way, in whole or part, any of the Contents of the Website, except that we grant you non-transferable, non-exclusive, limited permission to access and display the Website on your computer or device. This permission is on the condition that you do not modify the Content on this Website, keep intact any copyright or trademark notices, and accept the terms, conditions, and licences accompanying any Content contained within this Website.

Website Security: Users are strictly prohibited from violating or attempting to violate the security of this Website, including but not limited to: unauthorised access to data not intended for a user or logging into any server or account that the user is not authorised to access; attempting to scan or test the vulnerability of the Website or any system or network associated with the operation of photographmyproduct.co.uk; attempting to interfere with the service between the Website and any user, the secure operation of the Website, or the stability of the Website by means of submitting a virus to the Website, overloading, "flooding," "spamming," "mail bombing," or "crashing" the Website; and sending unsolicited emails, including promotions and/or other advertising of products or services.

Accuracy: We make every effort to ensure the accuracy of the information on this Website. However, we are not liable for typographic errors, pricing errors, omissions, or mistakes in the content of the Website. If you find an error, please contact us so we can fix it.

Linked Websites: This Website contains links to third-party websites. We do not accept responsibility for these links and do not endorse or monitor them for content. We shall not be responsible for any damage or loss sustained through the use of these linked websites or their services.

Internet Transmission Problems and Viruses: Due to transmission problems or technical difficulties with the Internet or this Website, it is possible to receive inaccurate, incomplete, or outdated copies of information from this Website. It is also possible for computer viruses or malicious software to affect this Website or be inadvertently downloaded. We shall not be responsible for any inaccurate or incomplete information delivered to you as a result of a technical or transmission problem. We are also not responsible for any damage caused by malicious software or viruses downloaded in connection with the use of this Website. We recommend using appropriate commercially available antivirus software to protect against such attacks.

19. Refusal of Service

If we feel your project is not a good fit, we reserve the right to refuse service and decline the project.

20. Indemnification

You agree to indemnify and hold us and our employees, officers, and owners harmless from any losses, including all attorney fees, resulting from any claims you make that are prohibited under these Terms due to any Limitation of Liability or other provision. You agree to indemnify, defend, and hold us harmless against any losses, including attorney fees, resulting from third-party claims alleging you did something that, if true, would violate any of these Terms.

21. Limitation of Liability

You assume full responsibility for any loss resulting from your use of our Service or Content to the maximum extent permitted by law. We and our employees, officers, and owners are not liable for any indirect, special, punitive, or consequential damages under any circumstances, including delays, even if based on negligence or if we have been advised of the possibility of such damages.

22. Severability

If any of these Terms are found unenforceable, such provision shall be modified only to the extent necessary to make the provision enforceable, and all other Terms shall remain in full force and effect. If we choose not to act on a breach of these Terms for whatever reason, it does not constitute a waiver of our rights with respect to such a breach or any subsequent breaches.

23. Attorney Fees

In the event of litigation, the prevailing party shall have the right to collect from the other party its reasonable costs, necessary disbursements, and attorney's fees incurred in enforcing this Agreement.

24. Equitable Relief

If you violate these Terms, we may seek injunctive relief from the courts or other equitable relief.

25. Assignment

You may not assign your rights under these Terms to any other party. However, we may assign our rights to any other entity or individual at our discretion.

26. Governing Law

These Terms shall be governed and construed under UK law as it applies to agreements between UK residents entered into and performed within the UK. Any action or proceeding arising from these Terms or your use of our Service or Content must be held in the UK Courts.

27. Client Responsibility and Acknowledgement

Project Brief and Creative Direction: As a client, it is your responsibility to provide a clear, specific, and detailed brief for each project. If you do not provide a detailed brief, you accept that the creative direction and decisions will be made by our production team, and you will be responsible for accepting and paying for the work delivered.

Acceptance of Final Product: You acknowledge that our team will use their professional judgement and expertise to create the Content. If you do not provide specific directions or a detailed brief, you agree to accept the Content produced. Requests for changes or reshoots due to dissatisfaction with the creative direction, where no prior specific instructions were given, will incur additional charges.

Communication and Approval: It is important that you communicate any changes or specific requirements promptly and ensure they are documented and acknowledged by our team. Once the shoot begins, changes to the brief will not be allowed, and you will be responsible for the costs incurred.

28. Video Production

Scope of Work: We provide video production services, which may include pre-production planning, shooting, editing, post-production, and final delivery. The specific services included in your project will be outlined in the estimate/invoice and any attached documents.

Creative Direction: You may provide creative direction for the video project, including scripts, storyboards, shot lists, and specific visual and audio elements. If you choose to exercise this creative direction, you must provide such direction in advance so it can be properly recorded on the invoice and/or any attachments. Any aspects of the project for which you have not provided specific creative direction will be left up to the judgment of our production team.

Briefing: We expect you to provide an accurate and specific brief for video projects. If the brief is not specified in detail, we will exercise our creative direction on your behalf. You waive the right to request changes to the Content once it is complete and must accept and pay for the work delivered.

Generalised Briefs: If you provide a generalised brief (e.g., "create a promotional video for our product") without specific details, you accept that the artistic and creative decisions will be made by our production team. We will not be responsible for any dissatisfaction if the resulting Content does not match an unspecified vision. Any reshoot requests caused by unclear direction will incur additional charges.

Changes to Brief: Any changes to the original brief that match the estimate must be communicated prior to the commencement of the video shoot. Such changes must be communicated in list form by email and acknowledged by a member of our team. Alterations are not allowed once the video production has commenced.

Estimates, Invoices, and Attachments: We will complete your video project as described on the estimate/invoice and any attached documents. Carefully review all documents to confirm they accurately describe the work you'd like performed. By submitting payment for an invoice, you agree that the invoice correctly describes the work.

Review Period: Immediately after the project is complete, you will receive an email containing a link to view the watermarked video Content. We allow up to 7 days for you to provide us with feedback. After 7 days, if we have not heard from you, we will invoice you for the work completed, and your order will be closed. The final, high-resolution video will not be delivered until the invoice is paid in full.

Reshoots and Edits: During the review period, you may request changes, such as reshoots or edits. We will only reshoot or edit free of charge if there is an error in following the agreed invoice or if minor post-production tweaks are needed. Additional or aesthetic-based changes that deviate from the agreed brief will be subject to further costs.

29. Scheduling, Booking, and Turnaround Times

Advance Booking: To minimise delays and ensure timely service, clients are encouraged to book projects well in advance. Our studio operates on a busy schedule, and advance booking is the best way to guarantee faster service.

Project Scheduling: While we strive to accommodate urgent requests, we cannot guarantee fast turnarounds for projects booked on short notice. All projects are subject to our current schedule and availability.

Turnaround Times: Completion times vary according to factors such as the complexity of the work, post-production requirements, and our overall workload. Quality remains our priority, and while we aim to complete projects promptly, we will not compromise standards for speed.

Busy Seasons and Larger Projects: During busy seasons or when working on larger, more complex projects, turnaround times may be extended. We will communicate any potential delays and work with you to find a suitable schedule.

Client Responsibilities: Providing all necessary materials and a clear, detailed brief in good time is vital for ensuring an efficient workflow. Delays caused by lack of information, late deliveries, or unclear direction may extend your project timeline.

No Guaranteed Deadlines: We will make every effort to meet your deadlines but cannot guarantee specific turnaround times. If you have strict deadlines, please communicate them clearly, and consider our rush services if available.

Rush Services: In certain cases, we may offer rush services for an additional fee. Rush services are subject to availability and must be agreed upon in writing. Even with rush services, some processes cannot be expedited without affecting quality.

30. Cancellation & Postponements

General Policy: Please note that postponements and date movements are also part of this cancellation policy.

Booking Commitment: Once the Client has made a booking for a specific time and date, we will not accept other work during that allotted period. Consequently, if a booking is cancelled or postponed, a fee will be charged: Cancellation/Postponement within Two Weeks — 50% of the booked time rate. Cancellation/Postponement within One Week — 100% of the booked time rate.

Expenses Incurred: In addition to the cancellation fee, the client will be charged for any expenses already incurred (e.g., model bookings, location fees, props, travel expenses).

Notification of Cancellation or Postponement: Clients must notify us in writing. The date on which we receive written notification determines the applicable cancellation fee.

31. Props and Food

Studio Props: We have a selection of studio props, but if specific props are required for your shoot, you may need to source them or arrange for them to be sent to us.

Simple Food Props and Flavour Cues: We can source local food items for simple setups, and we will add these costs to your invoice.

Complex Food Setups: For complex shoots requiring large quantities of food, out-of-season ingredients, or intricate recipes, you must arrange to deliver these items to our studio, ensuring that they arrive fresh and in suitable condition.

Client Responsibilities: Ensure that all props and perishable items are properly packaged and labelled for safe transit.

Local Sourcing and Invoicing: Any items we purchase for your shoot will be invoiced back to you. We will advise you of these costs beforehand whenever possible.

32. Day Rates and Single Image Pricing

Day Rate Package: The content produced under the day rate package is owned by Photograph My Product, although the client is granted a perpetual, worldwide, exclusive licence for use.

Full Studio Day Rate (8 Hours): Includes use of our studio, lights, gear, and photography services. If you're late or fail to show up, the scheduled time still counts towards the 8 hours. Payment is required in advance.

Half Studio Day Rate (4 Hours): Includes use of our studio, lights, gear, and photography services. If you're late or fail to show up, the scheduled time still counts towards the 4 hours. Payment is required in advance.

Single Image Pricing: For smaller requirements, you can pay per image. This includes photography and standard retouching.

Changes and Updates: Pricing may change; current rates will be provided in the estimate.

33. Display

The client grants Photograph My Product Ltd. permission to display any creative content covered by this contract for promotional purposes, unless agreed otherwise in writing. If you do not want your imagery used for promotional purposes, you must inform us in writing within 14 days after the shoot. Requests made after this period may not be honoured.

34. Amazon Product Photography Package

Package Description: Our Amazon Product Photography Package showcases a single product in a variety of images (hero, detail shots, infographic, lifestyle) to help you stand out on Amazon.

Pricing: The package is priced at £397, all-inclusive with no hidden costs.

Single Product Limitation: This package is designed for one product listing only and is not intended for multiple products, variations, or bundles of products.

Additional Products or Variations: Additional products or variations will be quoted separately.

Examples of Misuse: Attempting to include multiple different models, colours, or bundles within the single package will incur extra costs.

Client Responsibilities: Ensure that you provide accurate product information at the outset. Adding products or variations later will lead to additional charges.

35. Reselling and Redistribution of Images

Permitted Use: The images produced by Photograph My Product are licensed exclusively to the client for the purpose of listing and marketing their own products. This licence is non-transferable unless agreed in writing.

Prohibition on Reselling and Redistribution: You may not resell, redistribute, or transfer the images to third parties, including selling them to other businesses or bundling them with products or services intended for other businesses, unless you have a separate licence agreement from us.

Middlemen and Brokers: Intermediaries must disclose their status at the outset and secure proper licensing for third-party use. Failing to do so is a breach of these terms and may result in legal action.

Enforcement: Any unauthorised resale or redistribution immediately terminates your licence, and we reserve the right to pursue damages.

Exceptions: Any exceptions must be agreed in writing by Photograph My Product Ltd. before third-party use occurs.

36. Estimates and Actual Work Requirements

Estimates: Our estimates are based on information available at the time of quotation. This includes the number of products, complexity of the shoot, and time/resources needed.

Differences Upon Product Arrival: If your products differ significantly from what was described (in appearance, quantity, or complexity), we reserve the right to adjust the project scope and costs.

Client Notification: We will endeavour to inform you of any major differences in scope or cost before proceeding, but minor necessary adjustments may be made to meet your project timeline.

Client Responsibility: It is your responsibility to provide accurate information about your product(s). Inaccuracies may lead to added charges and delays.

Approval and Acceptance: By sending your products and accepting our estimates, you accept that additional fees may be charged if the actual work differs from the initial brief.

37. Additional Disclaimers

Platform Policy Changes: We are not responsible for monitoring changes in platform (e.g., Amazon) policies or guidelines. It is the client's obligation to ensure that any Content we produce complies with the latest standards set by Amazon or other sales platforms.

No Performance Guarantee: We are not liable for your sales performance, conversion rates, or any other marketing outcomes. Our service is limited to providing quality photography and/or video content; the effectiveness of the Content in the marketplace is solely your responsibility.

Regulatory and Legal Compliance: We do not provide legal advice regarding product claims, labelling, or regulatory compliance. You are responsible for ensuring that your product and any associated marketing materials meet all local, national, or international regulations.
